1. Introduction

KKON Interactive LLC (d/b/a Nahla.Chat) ("we," "us," or "our") respects your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, disclose, and protect information when you use the Nahla.Chat platform ("the Platform").

By using the Platform, you consent to the data practices described in this policy.

2. Information We Collect

2.1 Account Information

When you create an account, we collect your email address, display name (optional), and a hashed version of your password. We do not store passwords in plain text.

2.2 Chat & Conversation Data

We store messages you send and receive on the Platform, including text messages, AI-generated responses, and metadata such as timestamps. This data is used to maintain conversation history, improve AI responses, and provide you with a personalized experience.

2.3 AI-Generated Content

Images, voice notes, and videos generated during your use of the Platform are stored on our servers. This content is associated with your account and conversation history.

2.4 Usage Data

We collect information about how you use the Platform, including pages visited, features used, message counts, and interaction patterns. This data is used for analytics, platform improvement, and abuse prevention.

2.5 Payment Information

Payment transactions are processed by third-party payment processors. We receive transaction confirmation data (amounts, dates, subscription status) but do not store complete credit card numbers or bank account details on our servers.

2.6 Device & Technical Data

We collect IP addresses, browser type, device type, operating system, screen resolution, timezone, and referral URLs. We also generate a hashed device fingerprint (a non-reversible hash of your browser properties) to detect and prevent abuse such as free trial cycling. This information is used for security, fraud prevention, and platform optimization.

2.7 Cookies & Tracking

We use essential cookies for session management and age verification. We use analytics cookies to understand platform usage. We use referral tracking cookies (30-day duration) for our affiliate program. You can manage cookie preferences in your browser settings.

3. Information Collected from Creators

In addition to the information above, Creators provide:

• Photographs used for AI training and avatar generation.

• Voice recordings used for voice cloning.

• Personality descriptions, speaking style preferences, and biographical information.

• Government-issued identification for identity verification (processed by our KYC partner, Didit.me).

• Liveness verification data (selfie images for face-match verification).

Creator identity verification data is processed by our KYC partner Didit.me in accordance with their privacy policy. We store verification status and face-match reference images; we do not store copies of government-issued IDs on our servers.

4. How We Use Your Information

We use the information we collect to:

• Provide and maintain the Platform, including AI conversation, image generation, voice synthesis, and video generation.

• Process payments and manage subscriptions.

• Verify the identity and age of Creators.

• Prevent fraud, abuse, and unauthorized access.

• Improve the quality and safety of AI-generated content.

• Communicate with you about your account, transactions, and platform updates.

• Comply with legal obligations, including 18 U.S.C. § 2257 record-keeping requirements.

• Administer the affiliate referral program.

We do not sell your personal information to third parties. We do not use your conversation data to train general-purpose AI models shared with other platforms or companies.

5. AI & Memory

Our AI companions may extract and store contextual information from your conversations ("memory") to provide personalized interactions. This memory is stored per-companion and is associated with your account. You can reset conversation history and memory at any time from within the chat interface.

6. Data Sharing & Third Parties

We share data with third parties only in the following circumstances:

Service Providers: We use third-party services for AI text generation (OpenRouter), AI image generation and custom-model training (fal.ai), voice synthesis (Fish Audio), voice transcription (Groq), identity verification (Didit.me), payment processing (Whop), and hosting (Supabase, Vercel). These providers process data solely to provide their services to us and are bound by contractual data protection obligations. Specifically:

OpenRouter receives your current message and recent conversation context to generate AI responses, routing them to the underlying language-model provider.

fal.ai receives scene prompts (and, for creator accounts, uploaded training photos) to generate companion images and train optional custom models.

Fish Audio receives companion text to generate voice notes via text-to-speech.

Groq receives voice message audio for speech-to-text transcription.

Whop receives your email and session identifier to process payments.

Legal Requirements: We may disclose information if required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Nahla.Chat, our users, or the public.

Business Transfers: In the event of a merger, acquisition, or sale of assets, user data may be transferred as part of the transaction. We will notify affected users before their data becomes subject to a different privacy policy.

7. Data Retention

We retain your data for as long as your account is active or as needed to provide services to you. Specific retention periods:

Account data: Retained until you delete your account.

Conversation history: Retained until you reset the conversation or delete your account.

AI-generated images/videos: Retained until associated conversation is deleted or account is removed.

Creator verification records: Retained for a minimum of 7 years after account closure to comply with 18 U.S.C. § 2257 record-keeping requirements.

Payment records: Retained for a minimum of 7 years for tax and legal compliance.

When you delete your account, we will remove your personal data within 30 days, except where retention is required by law.

8. Data Security

We implement industry-standard security measures to protect your data, including encryption in transit (TLS/SSL), encrypted storage, access controls, and regular security assessments. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

9. Your Rights

9.1 All Users

You have the right to access your personal data, correct inaccurate data, delete your account and associated data, export your data, and withdraw consent for data processing (where applicable).

9.2 European Users (GDPR)

If you are located in the European Economic Area (EEA), you have additional rights under the General Data Protection Regulation (GDPR), including the right to data portability, the right to restrict processing, and the right to lodge a complaint with a supervisory authority. Our legal basis for processing your data is consent (provided through account creation and age verification) and legitimate interest (platform operation and fraud prevention).

9.3 California Residents (CCPA)

If you are a California resident, you have the right to know what personal information we collect, request deletion of your personal information, and opt out of the sale of personal information. We do not sell personal information. To exercise your rights, contact us at privacy@nahla.chat.

10. Children's Privacy

The Platform is not intended for individuals under 18 years of age. We do not knowingly collect personal information from minors. If we become aware that we have collected data from a person under 18, we will take immediate steps to delete that information and terminate the associated account.

11. International Data Transfers

Your data may be processed and stored in the United States and other countries where our service providers operate. By using the Platform, you consent to the transfer of your data to these jurisdictions. We ensure that appropriate safeguards are in place for international data transfers.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Platform and updating the "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the updated policy.
